Construction Materials: Regulation Conformity Certification according to QCVN 16:2023/BXD

Regulation QCVN 16:2023/BXD specifies the limit levels of technical characteristics and management requirements for "Group 2" construction materials and products as prescribed in the Law on Quality of Products and Goods. This applies to items domestically produced, imported, traded, circulated on the market, and used in construction projects within Vietnam.

This regulation does not apply to construction materials imported as: samples for advertising with no use value; samples for research; samples for testing; or goods temporarily imported for display at fairs and exhibitions.

Overview

Certification is a compulsory requirement for construction material products produced and circulated in Vietnam. All organizations and enterprises involved in manufacturing, importing, or trading construction materials must obtain QCVN 16:2023/BXD certification for their products.

Certification according to QCVN 16:2023/BXD

Construction materials significantly impact the quality of building projects; however, they are often prone to counterfeiting and low-quality imitations. To ensure project safety and protect the rights of legitimate businesses, the Ministry of Construction issued Circular 04/2023/TT-BXD on June 30, 2023, regarding National Technical Regulations for construction material products.

According to this Circular, QCVN 16:2023 took effect on January 1, 2024, replacing the old QCVN 16:2019/BXD. This certification activity involves evaluating and certifying products through a functional organization designated by the Ministry of Construction.

Content of QCVN 16:2023/BXD

  • Technical & Management Requirements: Governs quality standards for materials used in Vietnamese construction projects.

  • Safety Assurance: Products must remain safe during transport, storage, and proper use.

  • Applicable Subjects: Individuals and organizations manufacturing, importing, or trading construction materials; testing and certification bodies; and state management agencies.

List of Products Requiring Certification under QCVN 16:2023/BXD

  • Cement & Additives: Portland cement, blended sulfate-resistant Portland cement, blended Portland cement, granulated blast furnace slag, fly ash, phosphogypsum.

  • Construction Glass: Float glass, tempered glass, heat-absorbing glass, reflective glass, Low-E glass, laminated safety glass, sealed insulating glass units.

  • Tiles and Paving Stones: Natural stone, artificial stone (organic binders), ceramic tiles, interlocking concrete pavers.

  • Aggregates: Natural sand and manufactured sand for concrete and mortar.

  • Masonry Materials: Autoclaved aerated concrete (AAC), fired clay bricks, concrete bricks, hollow precast concrete wall panels (extrusion technology).

  • Roofing Materials: Asbestos-cement corrugated sheets, roofing tiles.

  • Sanitaryware: Washbasins, wall-hung urinals, bidets, water closets (toilets).

  • Other Materials: Wallcoverings (wallpaper, vinyl), chrysotile asbestos, fiber-reinforced gypsum panels, emulsion wall paints, wood-based panels, PVC/PE/PP pipes and fittings, GRP pipes, ductile iron pipes, cable ladder/tray systems, and electrical conduits.

Failure to comply with these mandatory regulations can result in administrative fines of up to 300,000,000 VND (under Decree 80:2013/ND-CP and Decree 119/2017/ND-CP) for violations such as:

  • Failure to register certification for products in the QCVN 16:2023/BXD list.

  • Failure to perform the "Declaration of Conformity."

  • Using counterfeit seals, certificates, or test results.

  • Selling products that have not been certified or declared according to the law.
