QCVN 3:2019/BKHCN is the National Technical Regulation regarding the safety of children's toys. This regulation was established based on Circular No. 09/2019/TT–BKHCN by the Minister of Science and Technology.
According to Clause 1, Article 2 of Circular 16/2011/TT-BGDĐT, children's toys are defined as any products or materials designed and manufactured for use by children under 16 years of age during play. Children's toys must meet the conditions of national standards for toy safety, excluding "self-made toys"—which are toys created by teachers, specialized staff, students, and parents for teaching and play purposes while still ensuring child safety.
Children's toys must satisfy the following conditions:
1. Toy Safety Toys equipped and used in schools must ensure safety during use as prescribed in Circular No. 09/2019/TT-BKHCN dated September 30, 2019, regarding the issuance and implementation of the "National Technical Regulation on the Safety of Children's Toys."
2. Educational and Aesthetic Characteristics
The market is flooded with toys from various domestic and international brands. Alongside reputable products, many "floating" items pose safety risks, making management difficult for authorities and selection hard for consumers. QCVN 3:2019/BKHCN was issued to provide a legal framework to manage these products effectively.
The standard aims to minimize hazards related to children's health and safety. It applies to all organizations and individuals involved in the manufacturing, importing, distributing, and retailing of children's toys.
Specific Chemical Limits
pH Levels: Liquid components in contact with the user must have a pH between 3.0 and 10.0 (excluding writing ink).
Formaldehyde: * Accessible textile parts: Max 30 mg/kg.
Accessible paper parts: Max 30 mg/kg.
Resin-bonded wood parts: Max 80 mg/kg.
Phthalates: DEHP, DBP, or BBP content must not exceed 0.1% by mass. Toys intended to be placed in the mouth must not exceed 0.1% for DINP, DIDP, or DNOP.
Aromatic Amines: Levels in raw materials must not exceed the limits set by this regulation.
