Administrative Penalties for Violations in Lubricant Quality

Specific regulations regarding penalties are as follows:

  • Measurement Sector: Maximum fines of 100 million VND for individuals and 200 million VND for organizations.

  • Standards and Product Quality Sector: Maximum fines of 150 million VND for individuals and 300 million VND for organizations (excluding specific cases cited in the Law).

  • Market Circulation: For products sold that do not meet quality standards, fines may increase by 2 to 3 times, or even 5 times the value of the goods.

  • Remedial Measures: Beyond administrative fines, violators may face measures such as forced recall and recycling, or destruction of goods harmful to human and animal health.

  • Corrective Actions: Obligatory correction of false information to prevent consumer confusion; forced removal from Vietnamese territory or re-export of imported goods.

  • Additional Sanctions: Suspension of production, import, or sales activities for 1 to 3 months.

For overseas factories manufacturing or processing products for import into Vietnam, the certification body will conduct assessments at the manufacturer's site. This includes evaluating production processes, quality management plans, and final product quality.
