QCVN 08:2020/BCT – Conformity Certification for Lead Content in Paints

The technical regulation QCVN 08:2020/BCT specifies technical requirements, test methods, and management regulations regarding lead content in paints manufactured, imported, and traded within the territory of Vietnam. Lead content refers to the percentage by mass of lead (calculated as metallic lead (Pb)) existing in all elemental and compound forms of lead present in paint.

Overview

Paint is a material used to coat product surfaces, providing high aesthetic value. Lead is used as a solvent in paint manufacturing because it possesses specialized properties that enhance paint performance. However, when exposure exceeds certain levels, lead can be toxic to humans, animals, and the environment. Therefore, Vietnam has established regulations regarding the maximum allowable lead content in paints.

Among these regulations, on December 21, 2020, the Ministry of Industry and Trade issued Circular No. 51/2020/TT-BCT promulgating the National Technical Regulation QCVN 08:2020/BCT on lead content in paints. This Circular took effect on July 1, 2022, and enterprises manufacturing and trading paint products are required to declare conformity before placing products on the market.

Currently, many enterprises have carried out conformity certification and conformity declaration for paint products in accordance with QCVN 08:2020/BCT. However, there are still many businesses that have not yet complied with this regulation. This raises concerns among consumers regarding the quality and safety of paint products introduced to the market.

Overview of QCVN 08:2020/BCT – Conformity Certification for Lead Content in Paints

Pursuant to Circular No. 51/2020/TT-BCT promulgated based on the National Technical Regulation QCVN 08:2020/BCT on limits of lead content in paints.

Accordingly, lead content refers to the percentage by weight of lead (calculated as metallic lead (Pb)) existing in all forms of lead and lead compounds present in paints, determined according to the test methods specified in QCVN 08:2020/BCT.

The permissible limits for lead content in paints must satisfy the following technical requirements:

Regulations on Conformity Assessment Methods

  • Import activities for paint products specified in Appendix A of this Regulation shall comply with Method 1 stipulated in Appendix II of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Minister of Science and Technology regarding the declaration of standard conformity, declaration of regulation conformity, and methods for conformity assessment with standards and technical regulations.
  • Domestic production activities for paint products specified in Appendix A of this Regulation shall comply with Method 5 stipulated in Appendix II of Circular No. 28/2012/TT-BKHCN and Circular No. 02/2017/TT-BKHCN.
  • Conformity assessment organizations shall comply with Point a, Clause 1, Article 8 of Circular No. 36/2019/TT-BCT.

Certification Process of ISSQ Quality Institute

Step 1: Receive certification registration documents

Step 2: Sign the scientific and technological service contract

Step 3: Conduct survey and assessment

Step 4: Complete documents after assessment

Step 5: Appraise documents and issue certification (if qualified)

Step 6: Conduct surveillance assessment every 12 months

Step 7: Conduct recertification assessment (certificate expires after 3 years)
