Why Must Children's Toys be Certified According to QCVN 3:2019/BKHCN?

Children's Toys: Any product or material designed or explicitly intended for use in play by children under 16 years of age.

QCVN 3:2019/BKHCN specifies safety requirements for children's toys, corresponding test methods, and quality management requirements for toys produced domestically, imported, or circulated on the market.

Overview

Children's toys are ubiquitous in daily family life. Because young children are inquisitive and lack the caution to recognize hazards, toy safety is always a paramount concern. Consequently, toy products must be declared and certified under QCVN 3:2019 in accordance with current laws before they are permitted for market circulation.

Regulations on QCVN 3:2019 Conformity Certification

The basis for granting conformity certification for children's toys includes:

According to Circular No. 18/2019/TT-BKHCN of the Ministry of Science and Technology (following the initial mandate from April 15, 2010), all domestically produced or imported toys may only be circulated on the market if the enterprise has obtained conformity certification and performed a declaration of conformity in accordance with the Vietnamese National Technical Regulation QCVN 3:2019/BKHCN.

Entities required to declare conformity:

  • Manufacturers of domestic children's toys.

  • Direct importers of children's toys from abroad.

Products Requiring QCVN 3:2019 Conformity Certification

According to the National Technical Regulation QCVN 3:2019, the following items are NOT considered children's toys:

  • Slingshots (stone shooters).

  • Assembly model kits or model airplanes/ships not designed for play.

  • Metal-tipped pointed arrows.

  • Air or compressed gas-operated guns and pistols.

  • Home or public playground equipment.

  • Bicycles (except those designed as toys with a maximum seat height of 435 mm).

  • Kites.

  • Equipment for sports, camping, athletics, musical instruments, and performance tools (however, toy versions designed as simulations of these items still fall under the scope of this regulation).

Consultation Process for QCVN 3:2019 Certification at ISSQ Institute of Quality

Step 1: Receive the application for QCVN 3:2019/BKHCN certification.

Step 2: Sign the Science and Technology service contract.

Step 3: Conduct surveys and evaluation audits.

Step 4: Finalize the post-evaluation documentation.

Step 5: Appraise the profile and issue the certificate (if requirements are met).

Step 6: Conduct surveillance audits at least once every 12 months.

Step 7: Perform re-certification (when the 3-year certificate expires).

Who Should Apply for QCVN 3:2019 Certification?

QCVN 3:2019 conformity certification is mandatory for all businesses manufacturing or importing children's toys.

  • Domestic manufacturers: Must obtain certification via Method 5 before launching products.

  • Importers: Goods must be certified via Method 7 before being released into the market.
